Adopted as s basis the draft Law “On Amendments to Certain Legislative Acts of Ukraine in Connection with Ratification of the Convention on Choice of Court Agreements” (No. 5120).
The draft law proposes to supplement Article 497 of the Civil Procedure Code of Ukraine and Article 366 of the Commercial Procedural Code of Ukraine with provisions that provide for the possibility of determining the jurisdiction of cases involving a foreign person by agreement of the party, as well as the Law of Ukraine “On Private International Law” by a new Article No. 41, in which to give participants in legal relations with a foreign element the right to enter into a choice of court agreement, “which is determine the jurisdiction of the courts of a particular State or one or more specific courts of a particular State of cases in disputes which have arisen or may arise between them in connection with such legal relations.”
