To ensure effective execution of the Cabinet of Ministers of Ukraine's authorities, coordination of executive power bodies, preliminary consideration of draft legal regulations, draft concepts and other documents submitted for the Cabinet of Ministers' consideration, the draft law No. 2354a provides for the following:
To form government committees as mandatory working bodies of the Cabinet of Ministers;
In order to build up a professional State machinery in the Cabinet of Ministers and ministries to introduce posts of State secretaries;
To distinguish the concept of departments of ministries as main structural subdivisions of the ministry's staff, formed to ensure fulfillment of the tasks of the ministry in a separate sphere of authorities, and the secretariat as a permanent structural subdivision, providing organizational, legal, logistical and other maintenance of the ministry's activity, etc.
The Committee members said that the draft law contains a number of other inaccuracies and inconsistencies of technical and legal nature, which however level down the legal approaches determined by the Constitution of Ukraine and the constitutional and legal doctrine. In particular, the amendments to Article 12 of the Law of Ukraine "On the Cabinet of Ministers of Ukraine" propose to define as one of the grounds for dismissal of the Cabinet of Ministers of Ukraine, stepping down from office before the newly elected Verkhovna Rada of Ukraine. However, the Constitution of Ukraine gives to the indicated ground different legal and political meaning.
The Committee members also made their remarks to the proposed by the draft law approaches to the formation and differentiation of other central bodies of executive power (other than ministries) and also the idea of withdrawing from ministries the possibility to exercise its powers through territorial bodies.
