First Deputy Chairperson of The Verkhovna Rada of Ukraine Ruslan Stefanchuk during the first sitting of the Parliamentary Working Group on drafting the law on recoding the civil legislation of Ukraine spoke about the main changes to be made to the second book of the Civil Code of Ukraine ‘Personal Intangible Rights.’
“The first is the issue of expanding the subjects of personal non-property rights. Personal inalienable rights must ensure the social existence of both individuals and legal entities and the state,” said Ruslan Stefanchuk. According to him, the second block is related to the ‘consolidation’ and specification of personal non-property rights.
“In particular, the allocation of new blocks that were not provided. This applies to reproductive rights and a number of others. The next big block is the expansion of rights related to the security of the individual. This is especially important now, during the Coronavirus pandemic. Another important block is the protection of the right to personal data and the strengthening of the right to privacy. Europe has adopted the GDPR. And we would like to implement some of its provisions in the civil legislation of Ukraine,” Ruslan Stefanchuk emphasized.
According to the politician, the strengthening of the right to privacy is justified, in particular by introducing the right to be forgotten, according to which a person has the opportunity to demand under certain conditions the removal of data about him from public access, which may become available through search engines.
“Another important block concerns the digital rights of the individual. We must guarantee every citizen of Ukraine the proper consolidation and civil protection of this category of rights,” said Ruslan Stefanchuk.
He also said it is important to discuss complex issues. All issues will be discussed as openly as possible. In the future, experts and all interested persons will be involved in the work on the Concept of updating the Civil Code of Ukraine.
“We stand on the principles of quality and efficiency of legislation. The fundamental things that will be required to reform the legislation must have a solid scientific basis. That is why we have gathered, perhaps for the first time, such an expanded circle of scientists and practitioners, MPs, in order to discuss issues related to the most important component of the legislation – civil law. I would like our discussions to be as open as possible,” Ruslan Stefanchuk stressed.
