Confirming Ukraine's respect to the European countries and European values;

- taking into consideration the Charter of Paris for a New Europe signed on November 21, 1990 and European Energy Charter adopted within the Final Document of the Hague Conference in European Energy Charter signed in the Hague (the Netherlands) on December 17, 1991;

- taking into consideration principles and goals of the Europe 2020 smart, sustainable, inclusive growth strategy dated March 3, 2010; Energy 2020 European Union strategy on competitive, sustainable and secure energy dated November 10, 2010; and the Energy Roadmap of the European Union 2050 dated 15, 2011;

- taking into account Ukraine's obligations within the Treaty on Foundation of the Energy Community and under the Protocol on Ukraine's joining the Treaty on Foundation of the Energy Community ratified with the Law of Ukraine No. 2787-VI of December 15, 2010;

- recognizing principles and requirements of the Third Energy Package and importance of bringing the regulatory and legal framework on general principles of functioning of domestic natural gas market in line with the requirements of the European Parliament and the Council of Europe's Gas Directive 2009/73/EC dated July 13, 2009 that concerns common rules for the internal natural gas market;

- obliging to implement the Association Agreement between Ukraine on the one hand and the European Union, European Atomic Energy Community and their member countries on the other hand as well as under the Agenda of the Ukraine-EU Association to prepare and assist implementation of the Association Agreement, as well as in view of implementation of the Partnership and Cooperation Agreement between the European Communities, their member states and Ukraine and within the framework of the European Neighbourhood Policy;

- recognizing importance of raising energy security of the state and bringing operation of the Ukrainian gas transport system in line with international requirements;

- acknowledging importance of the Ukraine's mission as a gas transit country and confirming the intention to remain a stable and reliable partner of the European Union in the field of gas transit through the territory of Ukraine;

- being committed to do its best to ensure effective operation of the integrated European natural gas market on the basis of joint interests and solidarity;

- willing to raise reliability of supplies within the framework of single regulatory space through introduction of stable regulatory system required for the region;

- striving for establishing closer political and economic relations with the EU member countries and for facilitation of energy investments;

- expressing agreement with the EU member countries and other international partners that oppose the construction of the Nord Stream-2 and Turkish Stream gas pipelines;

- supporting the Resolutions of the European Parliament dated January 21, 2016 and October 25, 2016, Statement by eight EU member countries of March 7, 2016 that addresses President of the European Commission Jean-Claude Juncker, conclusions of a council of foreign affairs ministers of the Baltic countries, northern countries of the European Union and the Visegrad Four states made within the framework of the Summit in the Republic of Poland on October 14, 2016,

The Verkhovna Rada of Ukraine:

  • Stresses that despite the military aggression of the Russian Federation, Ukraine remains a reliable partner in transiting natural gas to the European Union.
  • Draws attention to the fact that the Ukrainian Parliament has already approved a number of key legislative acts in order to bring the Ukrainian legislation in line with the requirements of the Third Energy Package and to bring operation of the Ukrainian gas transport system in line with the obligations Ukraine took under the Treaty on Foundation of the Energy Community. In particular, the legislative acts are: Law of Ukraine On Operation of Natural Gas Market; the Law of Ukraine On National Commission for State Regulation of Energy and Utilities and the Law of Ukraine On Amendments to Some Laws of Ukraine on Reformation of Single Gas Transport System Management.
  • Confirms its readiness to further reform the energy sector and take well-coordinated steps to ensure greater agreement of the energy policy between Ukraine and the European Union member countries.
  • Expresses deep concern over the intention to build transit gas pipelines bypassing Ukraine and considers that the implementation of respective projects:

- contradicts the EU energy security strategy that lies in diversification of sources and routes of energy supplies;

-  threatens energy security of countries in the Central and Eastern Europe that depend on gas supplies from one source;

- deprives the European Union of real competition and will prevent from creating effective energy union in Europe;

- jeopardizes further use of the Ukrainian gas transport system to supply gas to Europe and existence of Yamal - Europe route through the Republic of Poland;

- aiming to avoid creation of liquid and interrelated gas market within the Energy Community and unification of gas markets of Central, Eastern and Southern Europe with the market of the Energy Community;

- does not meet the purpose and principles of the Energy Community, requirements of the Third Energy Package concerning separation of functions of transportation and supplies of natural gas and ensuring access for third parties;

- is an economically unfounded investment at the expense of European customers.

  • Emphasizes that the construction of gas pipelines bypassing Ukraine is politically biased and aimed at promoting geopolitical goals of the Russian Federation to weaken Ukraine and destabilize the whole region.

Taking into consideration the aforementioned, the Verkhovna Rada of Ukraine calls on the European Parliament, European Commission, national parliaments and the European Union member countries to:

- support Ukraine on its way of energy reforms in compliance with its international obligations, of harmonization of the Ukrainian legislation with the one of the European Union and of integration of the energy markets of Ukraine with the market of the European Energy Community;

- get involved in joint modernization and operation of the Ukrainian gas transport system to guarantee sustainable transportation of natural gas to the EU member countries through the territory of Ukraine;

- adhere to the principle of solidarity and prevent implementation of politically-motivated projects on construction of gas pipelines bypassing Ukraine;

- assist in implementation of provisions of international agreements and internal European strategic documents that touch enhancement of energy security and improvement of cooperation in the energy sector between the EU and Ukraine.

A total of 264 members of the Ukrainian Parliament supported respective Resolution No. 5329.
