The Bill (Reg. No.4065) defines the basic principles of the State Service: law supremacy, observance of the Constitution, observance of the Law, superior professional skills, integrity, political neutrality, loyalty, publicity, transparency, stability, objectivity, openness, responsibility, and equal access to the State Service, whose realisation is a prerequisite of Ukraine's integration into the European Union.

 

The new Law will apply to State Officers in the State Authorities and other State bodies subject to the provisions stipulated in the Special Laws. It will not apply to those persons in political positions, and Assistance and Service personnel in the State Authorities, nor to workers in State-owned businesses, institutions and organisations.

 

The Bill regulates the issues of appointment, employment, and dismissal from the State Service, ie the procedure of registration at appointment and dismissal, holidays and leave entitlements, provision of social guarantees, etc.

 

At the same time, the Bill lays down comprehensive legislative protection for State Officers inter alia from political and other pressures; special guarantees and reporting terms, and disciplinary liability. It is proposed that those in political positions are to be dealt with separately from those in the State Service.

 

In addition, the document specifies unified procedures for employment in the State Service, irrespective of an employee's status or position, lays down an improved mechanism for open, transparent and objective competition, and introduces protection of the State Officers from illegal actions by their Superior Officers.

 

As regards the payment system, the Bill specifies the minimum official salary for the State Officer, which is to be at least twice the minimum wage, and requires that the official salary is at least 80% of the total monthly wage..

 

The document also specifies preconditions for  disciplinary  action taken against the State Officers, types of disciplinary  fines, bodies and officers entitled to impose such disciplinary fines, procedure for Disciplinary action, and appeals against  Disciplinary fines.

 

The authors of this Bill believe that its adoption will be a decisive step along the road towards the comprehensive overall reform of the State Service, and will facilitate the creation of a professional, neutral and efficient State Service within the European administrative service, providing effective and efficient operation of the State Authorities.
