Since 2014, the Russian Federation has been systematically undermining Ukraine's statehood, violating its territorial integrity, and threatening Ukraine's national security. Among other things, this was reflected in the fact that in some districts of Donetsk and Luhansk regions of Ukraine since 2014 there are terrorist organizations - the so-called "Luhansk People's Republic" and "Donetsk People's Republic".
The terrorist nature of the activities of these organizations, as well as the Russian Federation that supports them, has been repeatedly stated in official acts of the Verkhovna Rada of Ukraine, in particular:

1) in the Statement of the Verkhovna Rada of Ukraine "On the tragic death of people as a result of a terrorist attack on the territory of Ukraine", approved by the Resolution of the Verkhovna Rada of Ukraine №1596-VII of 22.07.2014, the Verkhovna Rada of Ukraine addressed international and European organizations, world leaders, in particular, with a proposal to recognize the self-proclaimed organizations of the DPR and LPR as terrorists. This Statement was approved in response to the downing of a Boeing-777 civilian aircraft near the city of Torez, Donetsk Region, on July 17, 2014;

2) in the Statement of the Verkhovna Rada of Ukraine "On Recognition of Ukraine's Jurisdiction of the International Criminal Court on Crimes against Humanity and War Crimes by Senior Officials of the Russian Federation and Leaders of Terrorist Organizations "DPR" and "LPR", which led to particularly serious consequences  and mass murders of Ukrainian citizens", approved by the Resolution of the Verkhovna Rada of Ukraine №145-VIII of 04.02.2015, also recognizes the terrorist nature of the so-called "DPR" and "LPR" with the support of the Russian Federation. This statement was approved after the shelling of "Hail" volley fire (multiple rocket launchers) from civilians in residential areas of Mariupol, Donetsk region, which occurred on January 24, 2015 due to the actions of armed groups of the Russian Federation and the so-called terrorist organizations "LPR" and "DPR" supported by it. .
On February 24, 2022, the Russian Federation launched a full-scale armed aggression against Ukraine, threatening Ukraine's statehood and territorial integrity.

At the same time, during the hostilities, the Russian Federation, its armed groups, as well as the armed groups supported by it, the so-called "DPR" and "LPR" (recognized as terrorist organizations in Ukraine) have repeatedly committed acts of terrorist activity. Among the many such acts committed since the beginning of the full-scale Russian military aggression against Ukraine, it is worth mentioning as indisputable examples of acts against civilians who do not take part in hostilities in a situation of armed conflict:

1) rocket attack on a residential building in the city of Kyiv on February 26, 2022;

2) rocket fire and rocket-propelled grenade fire on residential quarters and civilian objects in the city of Kharkiv on February 28, 2022 and March 1, 2022;

3) rocket attack on a television station in the city of Kyiv on March 1, 2022;

4) rocket attack on a residential building in the city of Chernihiv on March 3, 2022;

5) rocket attack on residential buildings in the private sector in the city of Bila Tserkva, Kyiv region, March 5, 2022.

Each such attack results in numerous civilian casualties - in particular, the above-mentioned attack on the city of Chernihiv on March 3, 2022 killed at least 47 people and injured 18 others.
At the same time, as a rule, shelling and attacks are carried out with such weapons that are available only in the Armed Forces of the Russian Federation and are not available in the Armed Forces of Ukraine. For example, during the missile attack on the Kharkiv Regional State Administration and Freedom Square (Ploscha Svobody), a "Caliber" winged rocket missile was used, which is not in Ukraine's arsenal.

Special attention should be paid to the actions taken by the Armed Forces of the Russian Federation in relation to nuclear energy facilities. Thus, on February 24, 2022, the Armed Forces of the Russian Federation seized the Chernobyl Nuclear Power Plant (ChNPP), which staff is held hostage and as of March 5, 2022, for 10 days in a row, the same shift of staff continues to ensure continuous operation. On the night of March 3-4, 2022, the Armed Forces of the Russian Federation carried out artillery shelling of the Zaporizhzhya Nuclear Power Plant, as a result of which a fire broke out at the NPP facilities.

Thus, the Russian Federation is committing acts aimed at killing or inflicting grievous bodily harm on civilians who do not take an active part in hostilities in the context of armed conflict. At the same time, the purpose of such actions is to intimidate the civilian population, create conditions for panic and suppress the psychological state of the population in order to achieve the surrender of Ukraine at the request of the Russian Federation.

Pursuant to Article 2 of the International Convention for the Suppression of the Financing of Terrorism, any person commits an offense within the meaning of that Convention if, by any means, directly or indirectly, unlawfully and intentionally provides or collects funds with intent to use them, or in the knowledge that they will be used, in whole or in part, to commit, inter alia, any other act aimed at causing the death of any civilian or any other person not actively involved in hostilities in a situation of armed conflict, or inflict grievous bodily harm when the purpose of such an act, by its nature or context, is to intimidate the population or compel a government or international organization to take or refrain from any action. Notably, according to the Convention, participation in the commission of such crimes, organization of other persons or their management for the purpose of committing such crimes, assistance in committing one or more crimes by a group of persons, if such assistance is intentional and provided either to support the criminal activities or criminal purposes of the group, or with awareness of the intent of the group to commit one of these crimes.

Additionally, Art. Article 6 of the Convention also stipulates that each Member State shall take the necessary measures to ensure that the criminal offenses set forth in the Convention are not justified under any circumstances on any political, philosophical, ideological, racial, ethnic, religious or other grounds.

In addition, the actions of the Russian Federation in relation to nuclear energy facilities are subject to the prohibitions established by the International Convention for the Suppression of Acts of Nuclear Terrorism. So, Art. 2 of the mentioned Convention establishes that a person commits an offense, in particular if they unlawfully and intentionally use or damage a nuclear object in such a way as to release or threaten to release radioactive material with intent to cause death or serious harm, material damage to property or the environment, to compel natural or legal persons, international organizations or states to take or refrain from taking certain action. Moreover, a threat to commit such acts is also considered the commission of a crime, if there are signs that indicate the reality of such a threat; as well as participation as an accomplice in the commission of such crimes, organization of other persons or management for the purpose of committing these crimes, assistance in committing one or more crimes by a group of persons, if such assistance is intentional and provided either to support criminal activity or criminal goals of the group, or with awareness of the intent of the group to commit one of these crimes. "Nuclear facilities" within the meaning of this Convention are, inter alia, any nuclear reactor, any facility or vehicle used for the production, storage, processing or transportation of radioactive materials.
The financing of the above-mentioned terrorist acts of the armed forces of the Russian Federation, as well as any armed formations supported by it, is subject to violations of a number of international legal acts.
It is undeniable that the Russian Federation, its armed forces and the illegal armed groups it supports are committing acts that fall within the scope of these terrorist activities. It is also indisputable that the Russian Federation finances such activities in fact at the state level, officially and openly. All this indicates that the Russian Federation, as a state, not only takes no measures to counter the financing of terrorism - the Russian Federation directly organizes and implements the financing of terrorism.

Hereby, the Russian Federation, contrary to FATF recommendation 6, ignores the need to implement UN Security Council Resolution 1373 (2001), which requires all states to prevent and counter the financing of terrorist acts.
The Committee takes note of the letter of the Head of the State Financial Monitoring Service of Ukraine to the President of the FATF Marcus Pleyer №1-Sunday / 210-09 dated 27.02.2022 with a request for recognition of the Russian Federation as a state contributing to the proliferation of weapons of mass destruction and including this Nation in the respective FATF list; exclusion of the Russian Federation from the FATF member states list.

The Committee also takes note of the "FATF Public Statement on the Situation in Ukraine", issued in March 2022, which states, inter alia: "The actions of the Government of the Russian Federation run counter to the fundamental principles of the FATF and constitute a gross breach of obligation that the Ministers of FATF member states agreed to implement and also support FATF standards. The FATF will review Russia's role in the FATF and consider what next steps are needed to uphold fundamental values."
The members of the Committee are convinced that the Russian Federation should not have a place among the FATF member countries, both in connection with the violation of fundamental principles of international law, which posed significant threats to the security and integrity of the world's financial system, and in connection with with the fact that the actions of the Russian Federation directly indicate violations of the prohibitions on terrorist financing and violations of the non-proliferation regime.
Given the above,

WE URGE YOU TO:

1. Immediately include the Russian Federation in the black list of high-risk jurisdictions.
2. Exclude the Russian Federation from the FATF member states as soon as possible.
