The Chairperson of the Verkhovna Rada of Ukraine Andriy Parubiy opened the Thursday’s plenary meeting.

MPs then proceeded with reviewing the second reading of the bill No.3112-1 on draft Electoral Code and amendments to it. None of them have been voted for.

On Ukraine’s electoral code

--Draft law No. 3112-1

By 230 ayes, the code was approved by the parliament. This сode defines the guarantees for citizens’ right to participate in configuring representative bodies of state power, the representative body of the Autonomous Republic of Crimea and representative bodies and elective representatives of local self-government, and also regulates preparations and holding of different types of elections.

The statute makes a standardizated and unified legal basis for the preparation and conduct of elections in Ukraine in accordance with its own constitution and recommendations of international organizations.

The code regulates the preparation and conduct of elections of the President of Ukraine, people's deputies of Ukraine, deputies of the Verkhovna Rada of the Autonomous Republic of Crimea, regional, village, rural, city etc. heads/ mayors, stipulated by the constitution.

The electoral code consists of three books - "General section", "National elections” and “Local elections".

The code specifies the peculiarities of the preparation and conduct of voting process and determining results of presidential elections in Ukraine, snap elections of the President of Ukraine and repeat elections (rerun) of the President of Ukraine, the general procedure for slating candidacies for the post of President of Ukraine by parties and through self-nomination, the conditions for registration of candidates for the post of President of Ukraine, the peculiarities of opening,  making and using electoral funds of candidates for the post of President of Ukraine, the specifics of the preparation and conduct of casting votes and determining results of the presidential elections in Ukraine.

As per the code, elections of people's deputies are conducted proportionally in accordance with electoral rolls of candidates from political parties. At that, in distribution of deputies’ mandates, there shall take part those candidates to have won five percent of the real votes in a national constituency. In this case, there will be used an electoral system that "allows it to personalize a vote (so called "open” lists of candidates).

The same system will be used for elections of deputies of the Verkhovna Rada of the Autonomous Republic of Crimea, oblast councils and city councils of those cities where the number of voters exceeds 90 thousand persons.

After the code enters into force, the laws of Ukraine "On Elections of the President of Ukraine", "On Elections of People's Deputies of Ukraine", "On Local Elections", "On the State Register of Voters", "On the Central Election Commission" shall all expire.

The electoral code will come into force on December 1, 2023.

 

On status and guarantees for hostages, convicts etc. outside Ukraine-controlled area

--Draft bill No.8205

On the first reading, there was taken by the parliament the draft bill No.8205 “On legal status and social guarantees for persons unlawfully deprived of their liberty, hostages or convicts in the temporarily occupied territories of Ukraine and outside”.

The bill defines main principles of the state policy in the sphere of granting legal status to persons unlawfully deprived of their liberty by illegal armed groups or law enforcement agencies of a foreign state, hostages, or persons unlawfully convicted, and ensuring their social guarantees and primary needs.

 

On Ukraine-Israel free trade treaty

--Draft law No.0223

The parliament adopted the law of Ukraine “On ratification of the Free Trade Agreement between the Cabinet of Ministers of Ukraine and the Government of the State of Israel”. The paper was signed in Jerusalem on January 21, 2019.

The agreement shall enter into force 60 days after the date of the last diplomatic note by which the parties inform each other that they have finalized all their internal legal procedures necessary for becoming the agreement effective.

The instrument does not cover the ORDLO area as well as the occupied Crimea until a complete de-occupation and restoration of Ukraine’s constitutional system there.

 

On EV charging stations

--Draft law No.10405

The parliament passed the law “On amendments to certain legislative acts of Ukraine regarding wider access to electric vehicle charging infrastructure”. The changes will allow it to legislatively protect the rights of drivers of vehicles equipped with electric motors to access to the charging stations.

 

On electricity from private households

--Draft law No.10357

The parliament passed the law “On amendments to the Article 9-1 of the Law of Ukraine “On alternative sources of energy” regarding settlement on electricity generation by private households”.

The law defines the procedure for calculating green tariffs for all, bar none, kinds of private households and consumers. Appropriate changes have been made to the Article 9-1 of the Law of Ukraine "On alternative sources of energy".

 

On attacks against activists

--Resolution No.10397

The parliament carried the resolution “On the report of the Verkhovna Rada of Ukraine temporary committee of inquiry over investigation of information about attacks against Kateryna Handziuk and other social activists”.  The Verkhovna Rada of Ukraine did take the report into consideration.

Due to a barrage of attacks against activists in Ukraine, the committee considered it necessary to re-draw attention of the Cabinet, the Prosecutor General's Office, the National Police, and the Security Service of Ukraine to an acute need for a full and comprehensive investigation of those attacks. The resolution terminated the committee’s mandate.
