The Bill (Reg. No. 0945) introduces amendments to the current Law appertaining to the right of village, settlement and city councils to delegate their authorities concerning issue of licensing documents to executive bodies.
During the discussion of the Bill, the Committee members stated that, pursuant to Article 10 of the Law, representative self-government bodies, village, settlement and city mayors and executive local self-government bodies act due to distribution of authority established by the said and other laws. Owing to this principle, the current Law determined separate authorities of village, settlement and city councils, their executive bodies and village, settlement and city mayors
The People´s Deputies drew attention to the fact that general authority of village, settlement and city councils includes two groups of authorities, pursuant to Articles 25 and 26 of the Law "On Local Self-Government in Ukraine" that determine general and exclusive authorities of village, settlement and city councils. The first group includes legally established authorities of village, settlement and city councils that can be delegated to executive bodies, village, settlement and city mayors. The said distribution of authorities of village, settlement and city councils is determined by Article 42 of the Law, pursuant to which, village, settlement and city mayor performs other local self-government authorities, established by the said or other laws, unless they belong to exclusive council authorities or are delegated to executive bodies by the council.
The second group of council authorities includes authorities in exclusive commission of village, settlement and city council. These authorities include issues, considered only at plenary meetings of village, settlement and city councils, and can not be delegated to other local self-government bodies and officials by the council resolutions.
The Committee also recommends that the Parliament rejects the resolution of The Verkhovna Rada of Ukraine № 999 "On Adopting as a Basis the Bill on Amendments to Article 26 of the Law "On Local Self-Government in Ukraine" of 3 May 2007 and withdraws it from consideration.
