This and other moves are included in a Bill on Amendments to the Law, 'On Local Self-government in Ukraine', Registered in The Verkhovna Rada of Ukraine.
The Bill (Reg. No. 1313) suggests citizens should be given an opportunity, at legislative level, to participate in Local Self-Government, through the Direct Democracy procedures and tools. It also seeks to resolve problems in relations between Local Councils and Local State Administrations, and to introduce monitoring of the adherence of regulatory acts, issued by Local Governments, to The Constitution of Ukraine and The Laws of Ukraine.
The Bill proposes to amend Clauses 7, 8, 9, 13, 19 of the Law, 'On Local Self- government in Ukraine', laying down the right of territorial communities to directly participate in Local Self-government, the procedure for the realisation of this right, and defining the content of the Local Community's Charter.
The Bill also proposes to resolve the problem of delegating Authorities to Chairmen of Local State Administrations by the relevant District and Regional Councils.
The Bill creates a provision which requires a territorial community Council to define the Legal Regulation of the procedure for the realization of the above provisions of this Law in The Territorial Community Charter, or the relevant corresponding Regulations approved by the Local Council. To prevent the excessive complexity of these procedures impeding their realisation, and to ensure there are free of legal gaps, the Bill envisages the establishment of the minimum obligatory requirements to The Territorial Community Charter, or Regulations on the realization of citizens´ rights to use direct Democratic tools, ie public hearings, local domiciliary meetings of citizens, and local initiatives.
Implementation of this Bill will require additional expenditure from The State Budget of Ukraine for launching a system to monitor the adherence of Legislative Acts issued by Local Governments to The Constitution of Ukraine and The Laws of Ukraine, and State Registration thereof, together with additional funding from Local Budgets for the obligatory placement of Local Government Acts on the Internet.
The Legislative Initiator believes that the passing of this Bill will contribute to the community involvement in Local Self-government in Ukraine, and will provide stability in relations between the public and Local Governments elected by them.
