The Bill (Reg. No. 1313) suggests that citizens should be given an opportunity, at legislative level, to participate in Local Self-Government, through Direct Democracy procedures and tools. It also seeks to resolve problems in relations between Local Councils and Local State Administrations, and to introduce monitoring of the adherence of Regulatory Acts, issued by Local Governments, to The Constitution of Ukraine and The Laws of Ukraine.
During the discussion of this Bill, Olexander Omelchenko, Committee Chairman, noted that ‘ the delineation of functions and authorities of Local Executive Authorities and Local Governments is today´s most vital priority´. Realisation of this task requires, according to him, the extension and improvement of current legislation.
O. Omelchenko pointed out that this Bill suggests additional Authorities of Local Governments. However, the responsibility and efficiency of local power can only be achieved if it enjoys financial and organisational independence. He stressed that in order for this Bill to be implemented it requires financing of additional Authorities of Local Governments.
The People´s Deputy, Anatoliy Matvienko, alerted the Meeting to the discrepancies in Clause 78 and 79 of the Bill, with regard to early Termination of Village/Community/City/District/ Regional Councils.
Implementation of this Bill will require additional expenditure from The State Budget of Ukraine for launching a system to monitor the adherence of Legislative Acts issued by Local Governments to The Constitution of Ukraine and The Laws of Ukraine, and State Registration thereof, together with additional funding from Local Budgets for the obligatory placement of Local Government Acts on the Internet.
Committee Members proposed that Laws appertaining to Local Self-government are combined into a single State Document, The Municipal Code of Ukraine.
