The Bill ( Reg. No. 1311) envisages Regulation, at a Legislative level, of the problems faced by Local State Administrations in exercising their Authorities, stemming from contradictions between various provisions in the current Law, 'On Local State Administrations', and provisions of the Laws, 'On Local Self-Government in Ukraine' and 'On The Cabinet of Ministers of Ukraine'.
Committee Members stressed at their Meeting that the suggested amendments to this Law clarify the status of The Chairman of the Local State Administration, provisions on the procedure for the formation of Local State Administrations, and delineate the functions of The President of Ukraine and The Cabinet of Ministers in this area.
The Bill also advocates that, ‘In the formation of the body of the Heads of Local State Administrations a personnel focused approach should be used. The Head of a Local State Administration shall be appointed from among those who are on The Personnel Reserve List of candidates suitable to occupy positions of Heads of Local State Administrations (selection to said List being decided on a competitive basis), or by the transfer of someone who, at the time of this appointment, is Head of another Local State Administration'.
It was also emphasized that ‘The Appointment and Dismissal of Heads of Local State Administrations should not be timed to the Termination of Authorities or the taking up of the position by The President of Ukraine, the Termination of Authorities or Resignation for other reasons, or the formation of a new Membership of The Cabinet of Ministers of Ukraine.
In the event that a Head of a Local State Administration Terminates his/her Authorities, The President of Ukraine may confer on one of his/her Deputies Temporary Authorities of the Head of the Local State Administration, for a period up until a replacement Head of the Local State Authorities is appointed under the laid down procedure.
