Draft Law 'On Amendments to Clause 48 of the Criminal Procedural Code of Ukraine' (relating to Defence Lawyers) is under Consideration by the Justice Committee

According to its author, Deputy Yu. Miroshnychenko, this Bill (Reg. No.4046) is aimed at ‘providing suspects, offenders who have been charged, and defendants with an adequate and suitable defence, and assisting the Defence Lawyer in the appropriate administration of his duties´.

The Defence Lawyer, inter alia, should be entitled to make abstracts and take copies of the documents subjoined to the case, since this prerogative is not sanctioned by Clause 48 of the existing Criminal Procedural Code.

The author considers the absence of this provision limits a Defendant´s rights, and makes it all the more complex to file an appeal or a cassation appeal against the Sentence.
