The corresponding Bill was registered in The Verkhovna Rada of Ukraine.
The author of the Bill, the people´s deputy Serhiy Husarov explains the necessity of the adoption of the law concerning private detective activities by the fact that in Ukraine such activities are not officially regulated by the legislation by this time, though they are performed de facto both by natural persons, and legal entities.
The Bill (Reg. No. 3727) determines the legal basis of the private detective activities, describes the task and principles of such activities, defines the subjects of the private detective activities.
The Bill defines the basic kinds of services, performed by the subjects of private detective activities, their power, as well as the restrictions during the conduct of detective activities.
In particular, it is suggested to determine that information can be collected on condition that a corresponding natural person or legal entity knows about it. The project prohibits the conducting of wire tapping, correspondence control and other special actions, the performance of which according to the legislation of Ukraine is allowed only for the special subdivisions of the law enforcing bodies with the court permission.
The Bill is also expected to determine the responsibility for the violation of the legislation concerning the private detective activities, the procedures of control over such activities.
The author supposes that the adoption of the law concerning private detective activities will allow to legalize this kind of activity, to clarify it and establish civilized "rules of the game", to provide the citizens of Ukraine with the possibility to protect their constitutional rights and interests.
