Opening hearings, Committee Chair Hryhorii Kaletnik reminded those present that the bill (Reg. No. 3238) was adopted as a basis by the Verkhovna Rada on October 24, 2013. In the course of its refinement for the second reading, the Committee received 511 proposals and amendments from the subjects of legislative initiative, of which 279 are recommended to be considered and 232 – to be rejected.
According to H.Kaletnik, the Committee decided to uphold the version of
the bill prepared for the second reading and to recommend the Verkhovna Rada
uphold it in the second reading and in entirety. While discussing the bill on determining the structure, content and procedure of adjustment of land development documentation, participants of the hearings stressed that this document was elaborated in connection with the fact that the existing Law “On Land Management” “is of declarative nature.”
In the course of his speech, the First Deputy Chairman of the State Agency of Land Resources of Ukraine Artem Kadomskyi stressed that the bill aims at eliminating negative situation in the sphere of land relations at the stage of adjustment and approval of land management documentation, which leads to abuse and corruption.
Chairman of the Land Management Department of the National University of Life and Environmental Sciences of Ukraine Andrii Martyn deems the bill attempts to make land management legislation more understandable.
The speakers upheld the decision of the Committee to recommend the Parliament adopt this bill in the second reading and in entirety.
Participants discussed the issue of making amendments to several legislative acts regarding determining legal regime of lands of collective ownership. They upheld the stand of the State Agency of Land Resources of Ukraine concerning this problem.
The issue of using agricultural land plots for commercial farming without land plots projects was also considered. It was noted that under the provisions of the applicable legislation, such actions entail a fine in the amount of 50 – 100 of citizens’ personal exemption (which, at present, is equal to UAH 850 – 1700), and if it goes about officials the amount of fine is equal to 300 – 500 citizens’ personal exemption (UAH 5100 – 8500).
Participants of the hearings took into account the fact that as of June
1, 2014 there are 18602 agricultural enterprises in Ukraine that use agricultural land
plots of ??over 100 hectares.
Of which 741 (4%) land users have land management projects. Participants
discussed reasons of slow pace of project generation. Proceeding from everything abovementioned, participants of the hearings upheld the proposal of the State Agency of Land Resources of Ukraine that is enshrined in the draft law, elaborated by the Agency.
