The Verkhovna Rada of Ukraine adopted the Resolution “On Statement of the Verkhovna Rada of Ukraine on termination of the decision of the Verkhovna Rada of the Autonomous Republic of Crimea of March 6, 2014 to hold the national Crimean referendum on March 16, 2014”

Under the draft document:

“In view of the fact that on March 6, 2014, the Verkhovna Rada of the Autonomous Republic of Crimea took the decision to holding the national Crimean referendum and inclusion of the Autonomous Republic of Crimea to the composition of the Russian Federation as its subject, the Verkhovna Rada claims:  

1. In connection with termination of the decision of the Verkhovna Rada of the Autonomous Republic of Crimea of March 6, 2014 on holding the national Crimean referendum on March 16, 2014 on the part of the acting President of Ukraine Oleksandr Turchynov in line with the Constitution of Ukraine, the Verkhovna Rada of Ukraine notes that the abovementioned decision of the Verkhovna Rada of the Autonomous Republic of Crimea contradicts the following articles of the Constitution of Ukraine: article 1, 2, 73, 20, 134, 133, part one of article 137 and part one of article 138.

2. Address of the Verkhovna Rada of the Autonomous Republic of Crimea to the President of the Russian Federation and the Federal Assembly of the Russian Federation contradicts articles 134 and 138 of the Constitution of Ukraine, under which the Verkhovna Rada of the Autonomous Republic of Crimea is not authorized to exercise foreign policy relations.

3. The Verkhovna Rada of Ukraine demands that the Verkhovna Rada of the Autonomous Republic of Crimea should immediately reconsider its decision of March 6, 2014 and bring it in line with the Constitution of Ukraine and the Constitution of the Autonomous Republic of Crimea, approved by the Law of Ukraine of December 23, 1998. In case the abovementioned decision is not brought in line with the Constitution of Ukraine and the Constitution of the Autonomous Republic of Crimea by the Verkhovna Rada of the Autonomous Republic of Crimea until March 12, 2014, the Verkhovna Rada of Ukraine will initiate the issue of early termination of powers of the Verkhovna Rada of the Autonomous Republic of Crimea.   

4. The Verkhovna Rada of Ukraine deems it expedient to address the European Commission for Democracy through Law (the Venice Commission) in connection with the decision of the Verkhovna Rada of the Autonomous Republic of Crimea of March 6, 2014 on holding the so-called national Crimean referendum on March 16, 2014.”
