The Committee on Judicial Policy recognized the draft law on amendments to several legislative acts of Ukraine re counteracting illegal digging and limiting civil circulation of archeological objects as non-contradicting to the provisions of the Constitution of Ukraine

The bill (Reg. No. 2616) aims at securing conditions for preservation and protection of archaeological objects as an important component of Ukraine’s cultural heritage. In particular, it is suggested amend and supplement several legislative acts regarding peculiarities of non-state ownership of archaeological objects and control over the use of search equipment. It is also suggested establish responsibility for illegal search and withdrawal of archaeological objects; violation of requirements of legislation on cultural heritage preservation; and violation of ownership rights to archaeological objects.   

The bill suggests supplement the Law “On Cultural Heritage Preservation” with a new section “Peculiarities of non-state ownership of archaeological objects”.

Committee members believe that the abovementioned supplement does not in full correspond to the Main Law of Ukraine.

In view of this, the people’s deputies believe that the bill requires refinement in order to adjust it to the provisions of the Constitution of Ukraine and the Civil Code.
