The bill (Reg. No. 2741) aims at settling the issue of legal status and material security of the personnel of the Supreme Court Secretariat. The respective amendments are to be made to the part five of article 149 of the Law “On the Court System and the Status of Judges” and to the article 6 and part five of article 46 of the Law “On Sate Service”, which comes into force on January 1, 2014.
It was stressed that the new Law “On State Service” does not include provisions on referring the positions of personnel of the Supreme Court secretariats, Higher Specialized Courts, Courts of Appeal and Courts of Original Jurisdiction to the respective subgroups of state officials.
At the same time, parliament members stressed that the bills eliminating the abovementioned gap in regard to all categories of positions in the courts of all levels and in other judicial bodies have been submitted to the parliament.
People’s deputies believe that adoption of the bill will allow refine legislative provision of legal status of the personnel of the Supreme Court of Ukraine Secretariat; and will ensure fulfillment of fundamental constitutional principles to prevent narrowing of content and scope of the existing rights and freedoms when adopting new laws or amending the existing ones.
