The Committee on Legislative Support of Law Enforcement recommends that the Verkhovna Rada should adopt in the second reading and in entirety the draft law on amendments to article 263-1 of the Criminal Code of Ukraine in connection with Ukraine’s accession to the Protocol against the Illicit Manufacturing of and Trafficking in Firearms, Their Parts and Components and Ammunition, supplementing United Nations Convention against Transnational Organized Crime

The bill (Reg. No. 1263) suggests a new version of the title and part 1 of article IX of the Criminal Code of Ukraine “Crimes against public safety”. It also suggests establishing criminal responsibility not only for manufacturing, processing, or repair of firearms, but also for counterfeiting, illegal removal or change of marking.   

Under the bill, “illicit manufacturing of and trafficking in firearms, or counterfeiting, illegal removal or change of marking, or illicit manufacturing of ammunition, explosives or explosive devices

entails a custodial sentence form three to seven years”.

It was noted that three amendments to the bill were received while preparing it for the second reading. One amendment was included in entirety, one – partially, and one was rejected.

People’s deputies upheld the amendment of the people’s deputy A.Kozhemyakin to the Final Provisions and rejected the amendment that excluded the word “counterfeiting” from the title and part one of article 2631 of the Criminal Code.
