Committee on Environmental Policy, Use of Natural Resources and Chornobyl Aftermath Mitigation does not uphold the draft law on amendments to several legislative acts of Ukraine re functions of the prosecutor's office

The bill (Reg. No. 1168) aims at bringing legislation in line with the Constitution of Ukraine and conclusions of the European Commission “For Democracy through Law” (the Venice Commission) by limiting functions of the prosecutor’s office, particularly, that of monitoring over human rights and freedoms observation and adherence to laws by the executive authorities, bodies of local self-government and their officials.

In particular, the bill stipulates elimination of inconsistencies of a number of legislative acts with the current Ukrainian legislation in the part of determining prosecutor's office functions.

Committee believes that in order to avoid double interpretation of legislative norms in a number of laws, the authors should carefully analyze them and make respective amendments in the part of supervisory functions of the prosecutor’s office to the Law “On the Prosecutor’s Office” and other laws determining functions of state supervision (control).

The Ministry of Environment believes that practical experience has proved the necessity of further execution of its functions by the prosecutor’s office in the part of supervision over adherence to environmental legislation by economic entities and suggests reject the bill.
