The Organized Crime Control and Anti-Corruption Committee recommends that the Parliament should adopt as a basis the draft law to amend article 12 of the Law “On Organizational and Legal Principles of Fighting Organized Crime” re the right of special forces

Document (Reg. No. 2418) excludes from current legislation the provision under which, special subdivisions on fighting organized crime can initiate and conduct pre-trial proceedings; transfer such proceedings to other bodies of internal affairs and security service bodies through the respective prosecutors that oversee execution of laws by special subdivisions; and following the same procedure demand and take criminal proceedings for crimes committed by organized criminal groups that are under the jurisdiction of the abovementioned bodies.

It was mentioned that this provision contradicts article 214 of the criminal and Procedure Code.

In view of adoption of the new Criminal and Procedure Code and its enactment on November 19, 2012, adoption of the bill will allow establish the single procedure of initiation and inflation of criminal cases.
