PLENARY MEETINGS OF THE ELEVENTH SESSION OF THE VERKHOVNA RADA OF THE SIXTH CONVOCATION WERE HELD ON TUESDAY, NOVEMBER 20.

 

At the beginning of the morning session one minute's silence was held by the people's deputies in memory of the member of the Committee on Transport and Communications, president of the Public Joint Stock Company “Azovmash” Oleksandr Savchuk, who has passed away on November 11.

 

The Chairman of the Verkhovna Rada V.Lytvyn informed on the results of work of the Verkhovna Rada of Ukraine during the plenary meetings of November 6.

 

The Chairman informed that the Constituent Congress of Advocates of Ukraine was held on November 17. According to article 131 of the Constitution of Ukraine, articles 10 and 11 of the Law "On the High Council of Justice" advocate’s congress adopted the decision to appoint the member of the Higher Council of Justice of the Higher Administrative Court of Ukraine Temkizhev Ihor Khazhmurydovych.

Authorized representatives of deputy factions took the floor with announcements, statements, information, and proposals.

 

V.Lytvyn suggested that people’s deputies adopt the decision regarding organization of further work before the new convocation of the Verkhovna Rada of Ukraine starts its work. He reminded that while planning the work of the Parliament for this plenary week, deputies proceeded from the fact that the Cabinet of Ministers would submit the draft of the State Budget for 2013 to the Verkhovna Rada of Ukraine.

 

“The Cabinet of Ministers, however, continues the work on the main economic document of the state for the next year and harmonizes all macroeconomic indicators. Thus, the question arose whether there is a need to work during the whole plenary week? This issue was discussed during the meeting of the Conciliatory Council. The decision was taken to consider the bills suggested by the government, as well as the laws vetoed by the President and to work until all the issues prepared for consideration on Tuesday are considered. It was decided to work in the committees and factions on November 21, 22, and 23 and to hold a plenary meeting on December 4,” V.Lytvyn informed.

 

People’s deputies adopted the decision to amend the Schedule of the eleventh session by 234 votes.

 

After voting, the Chairman noted: “if there is no State Budget, this will be the last meeting of the Verkhovna Rada of this convocation. If there is a Budget, then we will consider it on December 4-7.”

 

People’s deputies considered the issue on including a number of bills into the agenda.

 

The majority of the bills suggested were included into the agenda. Particularly, the parliamentarians considered whether it is necessary to include two bills on amendments to the Law “On state service” (re remuneration).

 

By results of voting, both bills were included into the agenda (236 votes “for”).

 

At the suggestion of the specialized committee, the decision was taken to postpone the consideration of the bill to amend several laws of Ukraine re transactions with foreign currency.

 

People’s deputies reconsidered two laws with the suggestions by the President of Ukraine.

 

The Verkhovna Rada adopted in entirety the Laws “To amend the Law of Ukraine “On Personal Data Protection” and “On Single State Demographic Register” with consideration of suggestions by the President of Ukraine.

 

Parliamentarians considered a number of bills in the second reading. Particularly, having considered the bill to amend several legislative acts of Ukraine (re Guarantee Fund enforcement of obligation concerning warehouse receipts for grain), they adopted it in the second reading and in entirety.

 

By results of consideration, the bill to amend section X of “Final Provisions” of the Land Code of Ukraine (re settling the issue of holding tenders) was rejected.

 

Peoples deputies considered amendments to the bill to amend the Land code of Ukraine (re circulation of agricultural lands).

 

By results of voting, none of the amendments was upheld (184 votes “for”).

 

People’s deputies rejected the bill to amend several legislative acts of Ukraine re regulation of town planning.

 

The Verkhovna Rada adopted the following bills in entirety: to amend article 2 of the Law of Ukraine “On State Procurement” (re procurement of works connected with operation of the National Bank of Ukraine); to amend several laws of Ukraine regarding improvement of vocational training management; on formation and placement of state commission on preparation of specialists, researchers, teachers and workers, professional development and continuing education; to amend the Law "On power industry" (re promotion of generation of electrical energy from alternative sources); to amend several legislative acts of Ukraine regarding employment of persons with disabilities; and to amend several laws of Ukraine (regarding state regulation and transport and road facilities management).

 

The bill on the system of professional qualifications was recommitted.

 

The bill to amend the Law “On Pre-School Education” (re organization of the educational process) was rejected by results of voting.

 

At the beginning of the evening session, people’s deputies continued considering the bills in the second reading. Particularly, they considered the bill to amend the Tax Code of Ukraine (re change of tax and levy rates) and adopted it in entirety by 234 votes.

 

The Verkhovna Rada adopted in entirety the bill to amend the Law “On Agricultural Cooperation” in the new version.

 

Then, people’s deputies considered two bills to amend the Law of Ukraine “On state service” (re remuneration) registered under No.No. 11401 і 11401-1. They were reported by Deputy Minister of Justice Dmytro Voron and the people’s deputy Vasyl Demchyshen.

 

People’s deputies stressed extremely low salaries of civil servants and the deficit of civil servants, especially young ones.

 

By results of voting, the bill registered under No. 11401-1 was adopted in entirety by 233 votes.

 

The Chair of the Committee on Agrarian Policy and Land Relations Hryhoriy Kaletnik suggested return to consideration of the bill to amend the Land Code of Ukraine (re circulation of agricultural land) registered under No. 11315 and extend moratorium on sale of agricultural land until January 1, 2016.

 

Having considered suggestions, the parliamentarians adopted the law in entirety by 269 votes.

 

The following draft laws were adopted as a basis: to amend several legislative acts of Ukraine regarding voluntary payment of a single fee; to amend several legislative acts of Ukraine (re ensuring access to judicial decisions); to amend several legislative acts of Ukraine regarding further refinement of tax and levy administration; and to amend the Tax Code of Ukraine regarding further refinement of tax and levy administration.

Parliamentarians considered five bills on disposal of out-of-service vehicles registered under No.No. 11259; 11260; 11437; 11442; and 11443.   

 

By results of voting, the bills on disposal of out-of-service vehicles (Reg. No. 11259) and to amend the Tax Code of Ukraine re payment of environmental tax for disposal of out-of-service vehicles (Reg. No. 11260) were adopted as a basis.

 

The Verkhovna Rada adopted the following draft laws as a basis: to amend several legislative acts of Ukraine regarding bringing the legislation into conformance with the Code of Criminal Procedure of Ukraine; to amend several legislative acts of Ukraine re informing people on the inclusion of GMO ingredients in food products; to amend the Law “On Basic Principles of State Supervision (Control) in the Economic Sphere” re limitation of interference into the activity of economic agents; and on amendments to clause 85 of the Budget Code of Ukraine (re financial support of higher medical education establishments and graduate medical education institution).

 

By results of voting, the draft law to amend the Law “On State Budget of Ukraine for 2012” (re realization of investment projects) was rejected.

 

People’s deputies considered two bills to amend the Decree of the Cabinet of Ministers of Ukraine “On State Duty” (re rates for conducting sate registration of property rights to immovable property) registered under No.No. 8296 and 8296-д.

 

The bills were reported by the Deputy Minister of Justice Inna Yemelyanova and the Chair of the Committee on Finance and Banking, Taxation and Customs Policy Vitaliy Khomutynnik.

 

V. Khomutynnik informed that the Committee recommends the Parliament to adopt this bill as a basis and in entirety.

 

People’s deputies upheld the decision of the specialized Committee by 233 votes.

 

The Verkhovna Rada adopted as a basis two bills: to amend several laws in connection with adoption of the Law “On State Service” and to amend several laws of Ukraine regarding national commissions to regulate natural monopolies.

 

The bill on the principles of Ukrainian electricity market functioning registered under No. 10571, was reported by the people’s deputy of Ukraine Ihor Hlushchenko.

 

The bill was adopted as a basis by 226 votes.

 

The draft resolution to reject the decision of the Verkhovna Rada of Ukraine to adopt as a law the draft Law of Ukraine “On All-Ukrainian Referendum” was reported by the people’s deputy of Ukraine Serhiy Sas. He stated that “the Constitution of Ukraine, as well as the Rules of Procedure of the Verkhovna Rada of Ukraine were outraged while adopting the law in the session hall”

 

The draft resolution was rejected.

 

The specialized committee suggested that people’s deputies of Ukraine should reconsider the bill to amend several legislative acts of Ukraine on regulation of town planning.

 

The bill was adopted in entirety by 238 votes.

 

The Chairman adjourned the evening session.

People’s deputies of Ukraine will work in the committees and factions on November 21, 22 and 23.

 

Next plenary meeting of the eleventh session will be held on December 4.
