The Committee on Judicial Policy declared the bill to amend the Law “On State Support to Families with Children” (re the conditions of childbirth welfare payment) as corresponding to the Constitution of Ukraine

The bill (Reg. No. 10640) suggests providing in part five, article 11 of the Law “On State Support to Families with Children” an exhaustive list of circumstances under which, childbirth welfare payment could be stopped, and supplementing it with articles 11-1 and 11-2 that determine the conditions of childbirth welfare payment suspension and its renovation.

 

According to the Main Law of Ukraine (part three of article 51), family, childhood, maternity and paternity are protected by the State.

 

According to clause 6, part one of the article 92 of the Main Law, the principles of protecting family, childhood, maternity and paternity are determined exclusively by the law. The adoption of laws belongs to the authority of the Verkhovna Rada of Ukraine, as the only legislative body in Ukraine.

 

The Committee upheld the bill that aims at preventing the abuse of depriving parents (foster parents) to receive childbirth state aid.
