The Committee recognized the bill on shifting Ukrainian economy to innovational model of development (Reg. No. 11151) determining main principles of introduction of the innovational model of economic development of Ukraine as non-contradictory to the legislation of the European Union and Ukraine’s obligations within the WTO.
By the subject of legal regulation the bill belongs to customs law, including indirect legal relations governed by the Treaty on the Functioning of the European Union; Agreement on Subsidies and Countervailing Measures of December 22, 1994 (Council Decision 94/800/EC of 22 December 1994 concerning the conclusion on behalf of the European Community, as regards matters within its competence, of the agreements reached in the Uruguay Round multilateral negotiations); Council Regulation (EC) No 1186/2009 of November 16, 2009 setting up a Community system of reliefs from customs duty; Note from the European Commission to the Council of the European Union and European Parliament and European Social and Economic Committee on more effective use of tax initiatives for the benefit of research and development.
The Committee concluded that the bill does not contradict to the law of the European Union and Ukraine’s obligations within the WTO, except clause 2 of article 12 of the bill.
The Committee considered also the bill to amend several legislative acts of Ukraine regarding improvement of regulation of certain issues of production and turnover of alcoholic drinks and tobacco goods (Reg. No. 11137).
The Committee concluded that provisions of the bill do not contradict Ukraine’s obligations within the WTO.
