The bill (Reg. No. 11094) suggests legislatively settle the issue regarding granting a pension for special merits before Ukraine to father for raising five and more children up to the age of six, in case of death of the mother or if she was deprived of parental rights.
It was stressed that the Main Law of Ukraine (part one and three of article 51) establishes equal rights of each member of a married couple in family and marriage. Family, childhood, maternity and paternity are protected by the state.
The Committee members consider it appropriate, reasonable and fair to grant pension for special merits before Ukraine to father for raising five and more children up to the age of six in the absence of mother.
People’s deputies believe that the legislative initiative corresponds to the principle of equality between men and women.
According to clause 6 of part one of article 92 of the Constitution of Ukraine, social protection, forms and types of pension coverage, principles regulating marriage and family are determined exclusively by the law. According to the Constitution of Ukraine, the adoption of laws pertains to the competence of the Verkhovna Rada of Ukraine, as the only legislative body of Ukraine (article 75, and clause 3 of part one of article 85).
