The Committee on Legislative Support of Law Enforcement recommends that the Verkhovna Rada should adopt as a basis the bill to amend the Code of Ukraine on Administrative Infringements and the Criminal Code regarding violation of state export control legislation

The bill (Reg.No.10564), submitted by the people's deputies V. Shemchuk, V. Stretovych and Yu. Prokopchuk, is to divide the responsibility of natural persons for violation of state export control legislation between criminal and administrative responsibility, as well as determine reasonable balance between them. Particularly, the bill provides a new version of article 333 "Breach of the procedure of international transfer of goods subject to state export control" of the Criminal Code determining the body of crime.

 

The authors stressed that the bill should be adopted to eliminate "competition of legal norms in the articles of the Code of Ukraine on Administrative Infringements and the Criminal Code”.

 

The Committee members upheld the bill, the adoption of which would allow for increasing efficiency of law enforcement measures and establishing criteria to separate administrative offenses and crimes in the sphere of state export control.
