PLENARY MEETINGS OF THE ELEVENTH SESSION OF THE VERKHOVNA RADA OF THE SIXTH CONVOCATION WERE HELD ON TUESDAY, OCTOBER 2.
At the beginning of the morning meeting, the Chairman of the Verkhovna Rada V. Lytvyn informed about the results of work of the Verkhovna Rada at plenary meetings on September 18.
By 349 votes the Verkhovna Rada cancelled its decision to adopt in the first reading the law to amend the Criminal Code and the Code of Criminal Procedure in Ukraine regarding increase of responsibility for offence against honour, dignity and business reputation of a person.
By 261 vote people’s deputies adopted the decision to continue the evening meeting till all agenda items are considered.
Authorized representatives of deputy factions took the floor with announcements, statements, information, and proposals.
The Chairman read out deputy inquiries.
Members of the Parliament considered the issues of ratification.
The bill “On Ratification of the Convention and the Protocol to it between the Government of Ukraine and the United Mexican States Government to avoid double taxation and prevent income and property tax evasion” was presented by the Deputy Minister of Finances Anatolit Miarkovskyi.
The Head of the Committee o Foreign Affairs Oleh Bilorus reported the decision of the Committee to recommend that the Verkhovna Rada should adopt the bill.
The bill was adopted by 267 votes.
The Verkhovna Rada ratified the Agreement between the Cabinet of Ministers of Ukraine and the Government of the Federal Republic of Germany on Financial Cooperation (appropriations in 2006 and 2007), project “To Increase Efficiency of Electric Power Supply (substation modernization)”.
People’s deputies included a number of bills into the agenda.
Members of the Parliament considered in the first reading two bills pertaining to regulation of powers of state bodies regulating tariff formation, development and formation of investment programs for economic agents in the sphere of heating supply, and centralized water supply and water disposal.
The bill to amend several legislative acts of Ukraine regarding the powers of the National Commission Regulating the Sphere of Utility Services was presented by the Head of the National Commission Regulating the Sphere of Utility Services Valeriy Saratov.
The bill to amend several legislative acts of Ukraine regarding regulation of activity of economic agents in the sphere of utility services was presented by people’s deputy Ihor Hlushchenko.
The Head of Sub-Committee of the Committee on Construction, Urban Development, Housing and Communal Services and Regional Policy Serhiy Mayboroda reported the decision of the Committee to recommend that the Verkhovna Rada should adopt as a basis the bill authored by people’s deputy I. Hlushchenko taking into consideration in the process of preparation to the second reading the provisions of the bill presented by the Head of the National Commission Regulating the Sphere of Utility Services.
By results of voting, the latter bill was adopted.
People’s deputies considered a number of draft resolutions on election and dismissal of judges and adopted the respective decisions.
Members of the Parliament continued considering the bills in the first reading.
The bill to amend several legislative acts of Ukraine regarding production of documents and forms for strictly accountable documents was presented by the Deputy Minister of Justice Inna Yemelyanova.
Deputy Head of the Committee on Economic Policy Yuriy Voropayev reported the decision of the Committee to recommend that the Parliament should adopt the bill as a basis and in entirety on condition that the norms concerning ballots for elections of the President of Ukraine, the Verkhovna Rada of Ukraine and local councils are excluded.
The Verkhovna Rada adopted the bill in entirety with exclusion of abovementioned norms by 234 votes.
People’s deputies considered and adopted as a basis the following bills: to amend the Law "On State Procurement" (re change of competition conditions); to amend clause 4 of chapter XXI “Final and Transitional Provisions” of the Customs Code of Ukraine regarding exemption from import tax of goods imported to the customs territory of Ukraine within the framework of projects (programs) at the const of international technical assistance provided under current international agreements, and initiative of the G8 countries “Global Partnership against Spread of Weapons and Materials of Mass Destruction”.
By results of voting, the following bills were rejected: to amend the Tax Code of Ukraine regarding production of documents and forms of documents of strict accounting, and to amend clauses 14 and 15 of chapter X “Transitional Provisions” of the Land Code of Ukraine regarding the term of land plots sale.
The bill to amend several legislative acts of Ukraine (re protection of children’s right to safe information space) was presented by people’s deputy Yevhen Tsarkov.
The first deputy head of the Committee on Freedom of Speech and Information Olena Bondarenko reported the decision of the Committee to recommend that the Verkhovna Rada should adopt this bill as a basis.
People’s deputies supported the decision of the specialized committee by 289 votes.
The following bills were adopted as a basis: on the system of professional qualifications; to amend several legislative acts of Ukraine regarding determination of parties to collective negotiations; to amend several legislative acts of Ukraine regarding improving the activity of Bureau of Credit Histories.

At the beginning of the evening meeting, people’s deputies considered in the first reading two bills to amend the Tax Code of Ukraine (re change of tax and levy rates). One of them was presented by people’s deputy Vitaliy Khomutynnik.
V. Khomutynnik reported the decision of the Committee on Finance and Banking, Taxation and Customs Policy to recommend that the Verkhovna Rada should adopt as a basis the bill he presented as the author.
The bill was adopted in the first reading by 230 votes.
The bill to mend several legislative acts of Ukraine regarding legacy registration was presented by people’s deputy Vasyl Shpak.
The bill was adopted as a basis by 281 votes.
People’s deputies adopted a number of resolutions on appointment of early local elections. The Verkhovna Rada appointed early local elections for Sunday, December 16, 2012.
Parliamentarians considered several bills included into the agenda
during the morning session. Particularly, o amend the Budgetary Code of Ukraine
regarding treasury payments and the Law of Ukraine “On the State Budget of
Ukraine for 2012” regarding financing of different programs.
The Verkhovna Rada adopted in entirety the following draft laws: the Law
“To Amend Article 16 of the Budgetary Code of Ukraine” regarding treasury
payments; the Law “To amend Annex No. 3 to the Law of Ukraine “On the State
Budget of Ukraine for 2012” (re nuclear fuel plants); the Law “To amend the Law
of Ukraine “O the State Budget of Ukraine for 2012” (re issues connected with
settling accounts with the State Committee of Ukraine for State Material
Reserve); to amend the Law “On the State Budget of Ukraine for 2012” (re
purchase of telecommunication equipment); the Law “To amend Annex No. 3 to the
Law of Ukraine “On the State Budget of Ukraine for 2012” (re nuclear fuel
plants); the Law “To amend the Law of Ukraine “On the State Budget of Ukraine
for 2012” regarding compensation of difference between procurement prices for
imported natural gas and its sale; the Law “To amend the Law of Ukraine ‘On the
State Budget of Ukraine for 2012’” regarding increasing expenses for
development of culture and state corporate rights and property management.
The following bills were adopted in the first reading: the bill to
amend several legislative acts of Ukraine (re payment of court fee); the bill
to amend section X of the “Transitional Provisions” of the Land Code (re
regulating the issue of holding tenders); and the bill to amend several
legislative acts of Ukraine regarding declaration of property, expenses and obligations
of financial character.
The Verkhovna Rada adopted the Resolution “To award the 2012 Prize of
the Verkhovna Rada of Ukraine for the contribution of youth in the development
of parliamentarism and local self-government”
People’s deputies considered amendments to the bills in the second
reading.
By results of voting, the following draft laws were adopted in entirety:
to amend article 15 of the Law "On Representation of the President of
Ukraine in the Autonomous Republic of Crimea" (re estate administration); On
Single State Demographic Register; to amend the Law "On Protection of
Personal Data".
Parliamentarians considered also amendments to several bills regarding
refinement of current legislation in the sphere of land relations. Taking the
abovementioned amendments into consideration, the following laws were adopted
in entirety: to amend several legislative acts (re deregulation of economic
activity of land surveying and land appraisal); to amend the Land Code of
Ukraine regarding acquisition of title to land”; and to amend the Law "On
Seeds and Planting Stock".
The following bills were adopted in entirety and in the second reading:
to amend article 18 of the Law of Ukraine "On Procedural and Institutional
Principles of Organized Crime Control" (re simplification of licensing of
currency operations); to amend the laws "On architectural activities"
and "On licensing particular types of economic operations" (re
licensing economic operations in the sphere of construction) and to amend
several legislative acts of Ukraine regarding state regulation in the sphere of
utility services.
The Verkhovna Rada of Ukraine adopted the Law “To amend the Law "On
peculiarities of ensuring openness, transparency and democratic character of
elections of people's deputies on October 28, 2012" (re refinement of
certain provisions) and the Law “to amend several legislative acts of Ukraine
regarding improvement of mechanism of regulating and strengthening
responsibility in waste management”.
People’s deputies considered amendments and adopted in entirety the Code
of Civil Protection of Ukraine and to amend legislative acts of Ukraine in connection
with adoption of the Code of Civil Protection of Ukraine.
By results of voting, the bill to amend several legislative acts of
Ukraine (re improvement of legal settlement of administrative relations between
the bodies of state monitoring in the sphere of civil protection, fire and
industrial safety and economic agents) was rejected.
A number of bills were adopted in entirety and in the second reading: to
amend several legislative acts of Ukraine regarding economic obligations; to
amend several legislative acts of Ukraine regarding performance of production
sharing agreements; to amend the Law "On State Regulation of Activity in
the Sphere of Technology Transfer; to amend several legislative acts on
citizenship; To amend several legislative acts of Ukraine in the part of
canceling requirements concerning the necessity of mandatory presentation of
hard copies of extracts from the Single State Register of Legal Entities and
Sole Proprietors; to amend the Law "On the Human Rights Commissioner of
the Verkhovna Rada of Ukraine" regarding national preventive mechanism; to
amend the Law of Ukraine "On the System of Deposit Guarantee" (re
refining the operation of the Fund and establishing the minimum sum of
reimbursement of deposit); to amend the Tax Code of Ukraine regarding checks in
connection with discontinuation of activity of sole proprietors without
employees on declarative principle; to amend the Tax Code of Ukraine regarding
improving taxation in the sphere of alienation of transportation means; and to
amend the Tax Code of Ukraine (re taxation of military-industrial complex
companies).
The Chairman adjourned the evening session.
On October 3-5, 8-12 people’s deputies will work in the committees and
factions.
Next plenary meeting of the eleventh session will be held on Tuesday,
October 16.
