The Committee on European Integration declared a number of bills as non-contradictory to the legislation of the European Union

Particularly, the Committee declared the bill to amend the Law "On Physical Training and Sports" (re motivation and social protection of sportsmen and coaches) (Reg.No.10736) as non-contradictory to the legislation of the European Union.

 

The bill suggests excluding article 43 from section four of the Law "On Physical Training and Sports". The document also suggests excluding the provision form article 48 of the Law "On Physical Training and Sports" according to which, rules of registration, accounting, exploitation and monitoring over the use and technical conditions of sports cars, sports motorbikes and sport aircraft is determined by the Cabinet of Ministers of Ukraine. These rules are also governed by the respective legislative acts.

 

The Committee noted that by the subject of legal regulation the bill pertains to the sphere of job safety which is regulated in the EU by the Treaty on the Functioning of the European Union; the European Sport Charter of 1975 (revised in 1992 and in 2001); the Charter of Fundamental Rights of the European Union; the European Social Charter (revised) and the European Code of Social Security (Revised). 

 

The Committee concluded also that the bill to amend several legislative acts of Ukraine regarding strengthening social guarantees for youth, disabled and other vulnerable populations (Reg.No.11063) does not contradict the legislation of the EU.

 

The bill suggests changing the order of granting vocation time to youth, disabled, women, and other categories of vulnerable populations; increasing requirements for youth employment; establishing additional employment guarantees for certain categories of population, etc.

 

The Committee noted that by the subject of legal regulation the bill pertains to the sphere of job safety and is regulated by the following documents: the Treaty on the Functioning of the European Union; the Charter of Fundamental Rights of the European Union; the European Social Charter (revised); the European Code of Social Security (Revised); the Commission Regulation (EC) No 1925/1999 implementing Council Regulation (EC) No 577/98 on the organisation of a labour force sample survey in the Community concerning the specification of the 2000 ad hoc module on transition from school to working life; Decision No 1145/2002/EC of the European Parliament and of the Council on Community incentive measures in the field of employment; Council Resolution on the promotion of employment for young people; the Resolution of the Council and the Ministers for Education meeting within the Council of 12 July 1982 concerning measures to be taken to improve the preparation of young people for work and to facilitate their transition from education to working life; the UN Universal Declaration of Human Rights; the International Covenant on Civil and Political Rights (1966); the Convention for the Protection of Human Rights and Fundamental Freedoms, 1950.

 

The Committee concluded that the provisions of the bill do not contradict the main principles of the EU policy in the sphere of providing employment guarantees to youth during transition from education to first working place and increasing requirements for youth employment.
