The Committee on Justice recommends that the Parliament should adopt as a basis the bill to amend the Law "On Court System and the Status of Judges" (re improvement of provisions on the status of court secretariat officials)

The bill (Reg. No. 11049) aims to ensure the exiting social status of state officials of judicial power by regulating social relations in the sphere of public service, preventing resignation of specialists in Ukrainian courts, etc.

 

Members of the Committee stressed that the bill presupposes legislative regulation of legal status of officials working in secretariats of general courts following the respective categories determined by the Law "On Public Service". In particular, to stimulate involvement of highly qualified professionals and prevent resignation of specialists, part 3 of article 151 of the Law "On Court System and the Status of Judges" proposes determining the subgroups that include the positions of assistants of judges of the courts of general jurisdiction.

 

People?s deputies drew attention to the fact that it is proposed to change the understanding of public service radically and introduce novelties concerning regulation of social relations in the sphere of public service.

 

The members of the Committee believe that as of today the issue of determining legal status of court secretariat employees is not governed by the current legislation and requires additional regulation.
