Adoption of the law to amend several legislative acts of Ukraine to delineate state-owned and municipal lands will not have negative effects.
The Chairman of the Verkhovna Rada of Ukraine Volodymyr Lytvyn stressed this answering the questions of Rada TV Channel on Friday.
"Unfortunately, the absolute majority of people?s deputies, who speaking about delineation of lands concentrate on the issue of land bank only, have not read the law at all," he said.
The adopted law, noted V. Lytvyn, "has great advantages but also some negative elements which should be taken into account in future." He explained that the law on delineating the lands according to the project principle, adopted in 2004, "did not have the necessary effect", as its implementation required "great funds, elaboration of the necessary projects, and adoption of respective decisions by the local authorities."
The new law, said the Head of the Parliament, contains the norm of direct action; it does not require adoption of respective decisions at the level of local authorities, "which leads to different confrontations." "It is obvious that community-, state-, and municipally-owned lands should be delineated. This law allows for doing that without additional financial expenditures," he noted.
V. Lytvyn reminded that the necessity to establish Land Bank is determined by the Land Code.
Nevertheless, said the Chairman of the Verkhovna Rada, it is necessary to take into consideration a number of provisions and bring them into conformance with current legislation. In particular, the law on banks and banking does not presuppose inclusion of material assets into statutory funds of banks, and the adopted law envisages the possibility of including state-owned lands into statutory fund.
Generally, noted V. Lytvyn, it is necessary to be realists and understand that people who have the act for right of land ownership of a land share should eventually get the possibility to dispose of this share at their sole discretion. "However, to achieve this, it is still necessary to adopt the law on land market," he said.
The Chairman of the Verkhovna Rada reminded that the Parliament had not included the respective bill into the agenda of this session. On the contrary, according to V. Lytvyn, the bill on postponement of land market introduction by January 1, 2014 was registered.
