The Committee on Environmental Policy, Use of Natural Resources and Chornobyl Aftermath Mitigation does not uphold the bill to amend article 134 of the Land Code of Ukraine (re lease of land plots occupied by water bodies and shore strips around them)

The bill (Reg. No. 10657) suggests supplementing the Land Code with provision stipulating that the lessees can lease water funds (land plots on which water objects and shore strips are located) without a land auction for a period that does not exceed the period of water object lease.

 

Members of the Committee stressed that fragmented amendment of the right to lease water objects in article 134 of the Land Code will lead to incomplete legal regulation in the sphere, which does not correspond to article 19 of the Constitution of Ukraine.

 

 

The Committee noted that the Proposals of the President of Ukraine to the Law "On Aquaculture", adopted by the Parliament, indicate the necessity to approach amendment of the Water and Land Codes comprehensively.

 

By results of discussion, members of the Committee concluded that the bill does not provide a comprehensive solution to the problem of leasing water objects and requires amendments to other laws. Therefore, the bill does not correspond to the requirements of articles 90 and 116 of the Law "On the Rules of Procedure of the Verkhovna Rada of Ukraine, article 51 of the Water Code and provisions of article 19 of the Constitution of Ukraine.
