The Committee on Legislative Support of Law Enforcement does not uphold the bill to amend several legislative acts of Ukraine regarding guaranteeing the principles of proportionality of interference into private life

The bill (Reg.No.10031) aims at ensuring implementation of the principle of proportionality of interference into private life by law enforcement bodies, as well as at refining legal mechanisms to protect the respective human rights.

 

The bill stipulates amending the Law "On Operational Activities" and the Criminal Procedural Code in the part of informing a person against whom measures regarding secret entry into a housing or other property of the person are taken; information retrieval from the person?s communication channels; control over correspondence, telephone conversations, telegraph and other correspondences; implementation of other technical means to gain information, only after such measures were taken.

 

People?s deputies stressed that on April 13, 2012 the Verkhovna Rada adopted new Criminal Procedural Code of Ukraine that will come into force on November 19, 2012. Thus, it is unreasonable to amend the current Code.
