The Committee on Justice recommends that the Parliament should reconsider the bill to amend the Civil Procedural Code of Ukraine (regarding clarification of some issues relating to consideration of case in absentia)

The bill (reg.No.9250) aims at improvement of the procedural rights of the participants of civil procedure in the part of decree and appeal of judgment by default and prevention of delays in judicial proceedings.

 

 

 

The bill suggests amending articles 169, 224, 225, 227, 228, 231, 232 and 297 of the Civil Procedural Code.

 

 

 

It is stipulated that in case the respondent fails to fulfill the order of revision of judgment by default the court refuses to accept an appeal.

 

 

 

The Committee members expressed several remarks to the bill.
