The Committee on Science and Education recommends the Parliament to reject the Bill on Amendments to the Law "Copyright and Related Rights" (regarding Royalty Payment by the Collective Management Organizations)

The bill (Reg. No6528) regulates relations between the organizations of collective management of copyright, defining the rate and order of royalties´ payment though conclusion of a multilateral treaty between the organizations of collective management of copyright and users of subject matters of copyright.

 

The Committee agreed with the recommendation of the Central Scientific-Experts Office of the Verkhovna Rada of Ukraine Secretariate to reject the bill. The experts believe that the adopted bill on amendments to several legislative acts regarding regulation of copyright and related rights (Reg. No.6523) improves Ukrainian legislation on copyright and related rights as to collective management of property rights of copyright and related rights proprietor and its harmonization with the requirements of the European Union. Under the bill, copyright and (or) related rights proprietor can transfer their property rights in trust to the corporate management organizations on a collective basis. Moreover, the experts stated that the mechanism of royalties´ payment suggested by said bill with the help of central executive power bodies in charge of intellectual property is more appropriate.
