The Committee on Legislative Support of Law Enforcement recommends the Verkhovna Rada to adopt the Bill on Amendments to the Criminal Code and the Code of Criminal Procedure regarding Specification of Certain Provisions

The bill (Reg. No. 9075) excludes clause 365 from the Criminal Code which introduces responsibility for exceeding authority or abuse of authority, and specifies provisions of part 1 of clause 365-1 which introduces responsibility for "exceeding authority by an official of legal entity of private law irrespective of organizational-legal form" and clause 365-2 which introduces responsibility for "exceeding authority by the individuals providing public services."

 

Under the bill, exceeding authority which was conferred on the official by the respective laws of Ukraine shall be recognized as criminally liable. Thus, reference to clause 365 of the Criminal Code of Ukraine is excluded from parts 1, 3 and 5 of the 112 of the Code of Criminal Procedure of Ukraine.
