The bill (Reg. No. 8642) amends the laws "On the Legal Status of Property of the Armed Forces of Ukraine" and "On Public Procurement" to regulate public procurement effected by the enterprises of the military-industrial complex.
The committee concluded that clause 2 of the law "On Public Procurement" conforms to article 15 of the Directive 2004/18/EC of the European Parliament and the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts.
Under this article, "certain centralised purchasing techniques have been developed in Member States. Several contracting authorities are responsible for making acquisitions or awarding public contracts/framework agreements for other contracting authorities. In view of the large volumes purchased, those techniques help increase competition and streamline public purchasing. Provision should therefore be made for a Community definition of central purchasing bodies dedicated to contracting authorities. A definition should also be given of the conditions under which, in accordance with the principles of non-discrimination and equal treatment, contracting authorities purchasing works, supplies and/or services through a central purchasing body may be deemed to have complied with this Directive."
The committee also concluded that clause 2 of this law conforms to article 16 of the Directive 2004/18/EC of the European Parliament and the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts.
