During the Session Week of May 31 - June 3, the Verkhovna Rada of Ukraine adopted 15 Laws and 16 Resolutions

The Law of Ukraine "On Amendments to the Law of Ukraine "On Amnesty in Ukraine" and other Legislative Acts of Ukraine" was adopted, being adjusted for the motions of the President of Ukraine. The legislative act presents a new version of the Law "On Amnesty in Ukraine." Under the Law, amnesty is a full or partial discharge of a particular category of persons found guilty in a crime, or those whose criminal cases were considered in court, but the verdicts has not come into force. 

 

The following Laws were adopted:

 

1. On Amendments to Clause 19 of the Economic Procedural Code of Ukraine (re Procedural Status of a Judge). The Law harmonizes the principles of clause 19 of the Economic Procedural Code of Ukraine with the effective legislation of Ukraine. The Law amends clause 19 of the Economic Procedural Code of Ukraine, stating that the procedural status of a judge is established by the Law "On Judicial System."

 

2. On Amendments to Clause 290 of the Civil Code of Ukraine (re Information about the Donor). The Law amends Clause 290 of the Civil Code, whereby the identity of the donor shall not be known to the recipient, while the identity of the recipient to the donor´s family, unless the recipient and the donor are married or are close relatives.

 

3. On Amendments to Clause 2 of the Law "On the Fundamentals of State Supervision (Control) in the Economic Sector" (re State Export Control). The Law supplements Clause 2 of the Law "On the Fundamentals of State Supervision (Control) in the Economic Sector", the effect of which shall not be extended on the relations connected with the state export control.

 

4. On Ratification of the Second Additional Protocol to the European Convention on Mutual Assistance in Criminal Matters. The Law ratifies the Second Additional Protocol to the European Convention on Mutual Assistance in Criminal Matters. Ratification of the Second Additional Protocol will allow Ukraine to introduce new forms of cooperation between the authorized bodies of the Contractual Parties during the investigation of crimes and legal proceedings on criminal cases in the form of mutual legal assistance. 

 

5. On Ratification of the Consular Convention between Ukraine and the Syrian Arab Republic. The Convention is based on the Vienna Convention on Consular Relations of April 24, 1963. The ratified Consular Convention establishes the functions of consular officials, and increases the level of their privileges and immunities. Under the Convention, a consular office can be opened in the territory of the state of residence only by consent of this state. Location of the consular office, its category, consular district and any respective changes are determined by arrangement of the accrediting state and the state of residence. 

 

6. On Ratification of the Agreement between the Government of Ukraine and the Government of the State of Israel on Mutual Promotion and Mutual Protection of Investments. Under the Agreement, each Contracting Party shall encourage and establish favorable conditions for investors of the other Contracting Party to make investments on its territory according to its national legislation. Each Contracting Party shall ensure that the regime for investments and incomes of investors of the other Contracting Party on its territory is not less favorable than the one it ensures for investments and incomes of its own investors or investments and incomes of any other Third Country.

 

7. On Amendments to several Legislative Acts of Ukraine regarding Surrender (Extradition). The Law implements item 2 of the Final Provisions of the Law "On Amendments to the Criminal-Procedural Code of Ukraine regarding Surrender (Extradition)" to meet the commitments of Ukraine under the international agreements on extradition. It harmonizes the provisions of Ukrainian laws to guarantee implementation of a new Chapter 9 of the Criminal-Procedural Code of Ukraine, esp. to regulate the detention of persons, whose surrender (extradition) or transit transportation is pending, and to implement the international agreements ratified by The Verkhovna Rada.

 

8. On Amendments to several Legislative Acts of Ukraine regarding Violation of Laws on the Personal Data Protection. The Law amends the Criminal Code of Ukraine, the Code of Ukraine on Administrative Infringements, the Code of Criminal Proceedings of Ukraine and the Law "On Information." Namely, it specifies the term ‘personal data´ in clause 23 of the Law "On Information"; sets administrative responsibility for infringements in the sphere of personal data protection in clauses 188-37 and 188-38 of the Code of Ukraine on Administrative Infringements; authorizes the state body on personal data protection to consider the cases on infringements (clauses 244-19 of the Code of Ukraine on Administrative Infringements); presents a new version of clause 182-1 of the Criminal Code.

 

9. On Amendments to Clause 18 of the Law of Ukraine "On Police" regarding Specialist Training. The Law supplements clause 18 of the Law "On the Police" with a norm, whereby military students of higher education establishments of the Ministry of Internal Affairs of Ukraine shall compensate the losses caused by the early termination of the agreement on specialist training in the higher education establishment.

 

10. On Amendments to Clauses 19 and 43 of the Law "On Labour Safety" (re Punitive Penalties). The Law strengthens administrative responsibility for the violation of laws on labour safety. The amendments to clause 19 of the Law "On Labour Protection" refer the employer´s expenditures for labour safety totaling at least 0,5 per cent to the sum total of the marketed production, works, goods and services for the year.

 

11. On Amendments to Legislative Acts of Ukraine regarding Special-Purpose Bonds. The Law improves regulation and control over the placement, circulation and redemption of special-purpose bonds, in particular, the bonds that require fulfillment of obligations through the transfer of project (part of the project) of housing construction.

 

12. On Amendments to Clause 2 of the Law of Ukraine "On Priority Actions to prevent Negative Consequences of Financial Crisis, and on Amendments to several Legislative Acts of Ukraine" (re Retirement of Bonds). The Law amends clause 2 of the Law "On Priority Actions to prevent Negative Consequences of Financial Crisis, and on Amendments to several Legislative Acts of Ukraine", excluding the provision, whereby "government stocks of Ukraine are subject to obligatory retirement by the National Bank of Ukraine, particularly by credits of specific purpose of the international financial organizations, at par value within five banking days since the proposal of retirement was received."

 

13. On Free Civil Legal Aid. The Law sets the grounds for and procedure of rendering free legal assistance, authorities of the executive bodies in the said sphere, the procedure of appealing against the resolutions, actions or passivity of the public authority bodies, local self-government bodies, their officials concerning rendering of free legal assistance.

 

14. On Amendments to several Laws of Ukraine regarding Regulation of Financial Services Markets. The Law authorizes the bodies in charge of state regulation of financial services markets to strengthen control over the financial services markets. The Law amends the Laws "On Financial Services and State Regulation of Financial Services Markets", and "On State Regulation of Securities Market in Ukraine." The Law "On Financial Services and State Regulation of Financial Services Markets" reads that corporate governance in financial institutions is performed in line with the laws on economic companies with account of this Law and other laws on specific markets of financial services.

 

15. On Amendments to the Law of Ukraine "On Electric Power Engineering" (re Guarantees of Government Liabilities concerning Promotion of Alternative Energy Sources). Under the Law, for the entire period of a green tariff use, the state guarantees purchase of all electric power produced on the facilities of electric power engineering with the use of alternative energy sources (apart from blast-furnace gas and coked gas, and in case of hydropower use the energy produced by small hydroelectric power stations), and not sold by contracts directly to the consumers or energy supply companies. The state guarantees full payments for such electric power within the established limits and under the legally fixed procedure.

 

The following Resolutions were passed:

 

1. On setting up the Interim Ad Hoc Panel of the Verkhovna Rada of Ukraine on the Autonomous Republic of Crimea.

 

2. On Events in the Verkhovna Rada of Ukraine concerning Celebration of the 20th Anniversary of Independence of Ukraine.

 

3. On the Report of the Prosecution General on the Criminal Proceedings against Former Prime Minister of Ukraine Yu.V.Tymoshenko.

 

4. On the National Military Memorial Cemetery.

 

5. On Celebration of the 70th Anniversary of Birth of Ivan Mykolaichuk.

 

6. On Withdrawal of the Law of Ukraine "On Legislative Support of the Pension Reform."

 

Several legislative resolutions were passed.

 

160 deputy inquiries were read out.

 

Several bills were adopted as a basis, recommitted, rejected, or withdrawn.
