The Committee on Judicial Policy recommends the Parliament to reject the Bill on Amendments to Clause 40 of the Law "On the Constitutional Court of Ukraine" (re empowering every People's Deputy of Ukraine to file a Personal Constitutional Appeal on ruling Unconstitutional the Acts of The Verkhovna Rada of Ukraine adopted with Violation of the Personal Voting Procedure)

The bill (Reg. No. 8328) empowers every People´s Deputy of Ukraine to address the Constitutional Court as to ruling unconstitutional the laws and other legal acts of The Verkhovna Rada of Ukraine adopted with violation of the personal voting procedure. The bill amends clause 40 of the Law "On the Constitutional Court of Ukraine."

 

The Committee concluded that the bill contradicts part two of article 19 of the Constitution of Ukraine, whereby public authorities and bodies of local self-government and their officials shall be obliged to act only on the grounds, within the powers, and in the way determined by the Constitution and the laws of Ukraine.
