The Committee on Judicial Policy reviewed the Bill on Amendments to Clause 123 of the Family Code of Ukraine (re Affiliation of the Child born in the Result of Use of Adjuvant Reproductive Technologies) as to its Compliance with the Constitution of Ukraine

The bill (Reg. No. 8212) clearly defines the concept of marital partners for those entitled to use the adjuvant reproductive technologies. Thus, marital partners are a male and a female. 

 

Applicable laws do not allow registration of same-sex marriage in Ukraine. Under Clause 21 of the Family Code of Ukraine, marriage is a family union of a female and a male registered by the civil registration office. However, the law does not define the concept of marital partners.

 

Adoption of the bill will prohibit foreign citizens staying in a same-sex marriage to use the services of surrogate mothers - citizens of Ukraine.
