The Committee on Legislative Support of Law Enforcement recommends the Verkhovna Rada to adopt the Bill on Amendments to the Code of Criminal Procedure of Ukraine regarding Support of the Right of Defense of the Suspected Person, the Accused Person, and the Defendant in the Second Reading and in its Entirety

As reported, adjusting the bill (Reg. No. 6654) to the second reading, the Committee received 27 proposals from the subjects of the legislative initiative, 20 of which were taken into account fully, 1 partially, 6 were rejected.

 

The Committee members recommend considering the proposal of People´s Deputy V.Shvets, which supplements Clause 44 of the Code of Criminal Procedure of Ukraine with new provisions, whereby the defender is granted access to the case immediately after submitting the documents certifying their authorities, but not later than 24 hours after the defender´s appeal for access to the case was received.   

 

The bill also amends clause 106, whereby "after 72 hours since the moment of detention, the suspected person is entitled to discharge, unless the preventive measure in the form of custody was taken."
