The delegation includes Committee Secretary
Volodymyr Tolstenko, Committee Sub-Chairman Vladyslav Zabarskyi, Deputy Head of
the Secretariat Ihor Tkachenko,
and Head of the Bar Association "Ukrainian Human Rights Foundation" Volodymyr Shakhrai. Wolfgang Eichele,
Director of the German Federal Bar, Henning Hübner,
Head of the German Federal Bar on the Professional Regulation of Advocacy, representatives
of the German Advocacy Institute and the Federal Bar Chamber took part in the
meeting.
Head of the Ukrainian delegation Volodymyr Tolstenko thanked the German counterparts for the opportunity to learn the structure and authorities of the German Federal Bar and the Federal Bar Chamber. He laid emphasis on the leading role of the bar chamber in the accession of attorneys to the professional activity.
The participants of the meeting discussed the access to the legal profession, and professional responsibility of the lawyers.
Debating the authorities of the lawyers in Germany, Chairman of the Sub-Committee on Civil Legislation V.Zabarskyi drew attention to the provisions of German laws, whereby the attorneys have an exclusive right for legal representation in Germany.
The attendants dwelled upon the professional ethics of the attorneys. Dr Henning Hübner informed the Ukrainian delegation about the provisions of the federal laws concerning responsibility for attorney-client privilege, procedure of termination of advocacy, etc.
The Parties also discussed the system of advocacy self-government, especially, strengthening of the role of self-governing organizations of attorneys.
The German participants dwelled on the protection of attorneys´ professional rights, distribution of authorities between the non-governmental association of the German Federal Bar and the Federal Bar Chamber, the functions and authorities of which are determined in the federal law on advocacy.
The Parties called for establishing cooperation on the key issues of advocacy in Ukraine and Germany.
