The Committee on Construction, Urban Development, Housing and Communal Services and Regional Policy recommends the Verkhovna Rada of Ukraine to adopt the Bill on Amendments to several Legislative Acts of Ukraine regarding Regulation of Collection of Fine for Delay in Payment of Public Utility Services and Activity of Performers/Providers of such Services

The bill (Reg. No.8161), submitted by the People´s Deputies Yu. Serbin and M. Potapchuk, amends the Laws "On Housing and Communal Services" and "On Fundamentals of the State Regulatory Policy in the Sphere of Economic Activity." The bill grants the right to a consumer of these services not to pay fine for delay in payment of public utility services caused by arrears in wages, pension, educational scholarship or other social payments. Therefore, part 1 of clause 20 of the Law "On Housing and Communal Services" that defines consumer rights and duties is supplemented with item 7, whereby the consumer has the right "not to pay fine for delay in payment of public utility services caused by arrears in wages, pension, educational scholarship or other social payments which determine their paying capacity or on condition they receive income that does not exceed a monthly minimum subsistence in terms of payment of public utility service and providing documentary proof in order established by the Cabinet of Ministers of Ukraine."

 

The Committee members upheld the bill, as its adoption will protect the socially insecure groups of population from the consequences of delay in payment of public utility services caused by arrears in wages, pension, educational scholarship or other social payments.
