The Committee on European Integration concluded that the Bill on Amendments to the Law "On Indemnification of Damage sustained by the Citizens from the Agencies of Inquiry, Prejudicial Inquiry, Prosecution and Court" (re Damage sustained due to the Non-Observance of Procedural Terms) meets the International Legal Commitments of Ukraine

The bill (Reg. No. 6442) amends the applicable Law, envisaging indemnification of damage sustained by the citizens due to the non-observance of procedural terms of legal proceedings, аnd harmonizing it with clause 1176 of the Civil Code of Ukraine (re indemnification of damage inflicted by the miscarriage of justice).

 

By the subject of legal regulation, the bill refers to the scope of the European Convention for the Protection of Human Rights and Fundamental Liberties of 1950, Recommendation Rec(2004)6 of the Committee of Ministers to member states on the improvement of domestic remedies, Recommendation CM/Rec(2010)3 of the Committee of Ministers to member states on effective remedies for excessive length of proceedings, and Recommendation CM/Rec(2010)12 of the Committee of Ministers to member states on judges: independence, efficiency and responsibilities.
