The Committee on Legislative Support of Law Enforcement recommends The Verkhovna Rada to adopt the Bill on Amendments to the Criminal and the Criminal-Procedural Codes regarding Examination of Minor Victims and Witnesses

The bill (Reg. No.7340), submitted by People´s Deputies of Ukraine E. Suslov and Yu. Miroshnychenko,  regulates the procedural peculiarities of case investigation with minor victims and witnesses.

 

The bill supplements clause 85-1 of the Criminal-Procedural Code of Ukraine with the part 5 of the following content:

 

"Video recording of evidence of minor victims or witnesses shall not be demonstrated in the course investigative actions and familiarization with materials of case. Video recordings of evidence of minor victims or witnesses are not added to the materials of case, by are kept separately by the authorized body. Copy of video recording of evidence of minor victims or witnesses are added to the materials of case after all the necessary measures have been taken to conceal the faces of victims or witnesses and make voice of victims or witnesses impossible to identify."

 

People´s Deputies upheld the bill, having expressed several remarks, according to which some norms of the bill contradict clause of the Criminal-Procedural Code and put obstacles in the criminal case. According to the parliamentarians, certain clauses of the bill are not harmonized with the requirements of legal framework and contain unclear definitions, thus they need correcting.
