The European Integration Committee concluded that several Bills complied with the Laws of the European Union, Ukraine's Commitments within the Council of Europe, and GATT/WTO Standards

Опис : C:\Documents and Settings\Имя\Рабочий стол\1.jpgThe Committee scrutinized the bill on amendments to the Criminal Code of Ukraine (re criminal responsibility for evasion of service of sentence) (Reg. No. 6681). The bill amends clauses 52, 389 and 390 of the Criminal Code of Ukraine to extend their effect not only onto the persons whose punishment was awarded by court judgment, but also on those whose punishment was awarded under clause 82 of this Code as a change of the unserved part of punishment for a more lenient sentence.

 

Analyzing the bill, the following standards of the Council of Europe should be considered: the European Convention on the Supervision of Conditionally Sentenced or Conditionally Released Offenders; Recommendation of the Committee of Ministers of the Council of Europe No. R (92) 16 on the European Rules on community sanctions and measures; Recommendation Rec(2003)22 of the Committee of Ministers to member states on conditional release (parole); Committee of Ministers Resolution (65) 1 on suspended sentence.

 

The Committee members concluded that the bill meets the international legal commitments of Ukraine.

 

The Committee also scrutinized the bill on certain aspects concerning streamlining of the tax system in Ukraine (Reg. No.7257). The bill relieves the tax load on particular economic entities and introduces subsidies for the companies employing more than 50 persons, provided the number of working places grows by 10 % per year.

 

The bill refers to the sphere of competition regulation and taxes. In the European Union, this sphere is regulated by the Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax and the Commission Communication for the European Parliament, European Council, European Economic and Social Committee, and the Committee of Regions "Small Business Act".

 

The Committee members concluded that the bill does not contravene the EU laws.
