The Committee on Judicial Policy recommends the Parliament to adopt the Bill on Amendments to several Legislative Acts of Ukraine regarding Support of Child's Rights for the Freedom of Movement

No.7522) regulates the procedure of acquiring a travel document for a child, and child´s crossing the border if there is no consent of one parent. The bill authorizes the wardship and guardianship authorities to give a respective consent.  

 

The Family Code is supplemented with the clause, whereby the wardship and guardianship authorities can settle the issues to support the child´s right for the freedom of movement. Thus, "in case there is no possibility to reach consent between the parents of a child regarding its leaving abroad, the parent initiating child´s travel abroad shall have the right to appeal to the wardship and guardianship authorities to settle this matter."

 

The bill "will prevent abuse of the legitimate right of a child for the freedom of movement and child´s representation by the parents, solving the problem of evading the parental responsibilities in part of the child´s rights for the freedom of movement."
