The Committee on Social Policy and Labour recommends the Verkhovna Rada of Ukraine to reject the Bill on Amendments to several Legislative Acts of Ukraine (re preventing Dismissal of the Persons with Disabilities by Staff Redundancy or Downsizing)

The bill (Reg. No. 8087) supplements clause 40 of the Code of Labour Laws of Ukraine and clause 17 of the Law "On the Fundamentals of Social Security of the People with Disabilities in Ukraine" with a provision, whereby the owner or the authorized body can not dismiss the persons with disabilities, except insofar as complete liquidation of the enterprise, institution or organization, when dismissal with further obligatory employment is allowed.  

 

The Committee members stated that the applicable version of clause 40 of the Code of Labour Laws of Ukraine and clause 17 of the Law "On the Fundamentals of Social Security of the People with Disabilities in Ukraine" fully meets the requirements of the Convention of the Rights of Persons with Disabilities ratified by Ukraine in December, 2009. Thus, the Committee members consider it unreasonable to amend these provisions.
