The Committee on Justice does not uphold the Bill on Compensation for Losses inflicted by Illegitimate Actions of the Public Authorities or Local Self-Government

No. 4672) sets the order of compensation for property and moral (non-property) damage inflicted by illegitimate resolutions, actions or inactivity of the public authorities, local self-government, or their officials during the performance of their duties.

 

The bill specifies the types of damage subject to compensation, the grounds for compensation, its rate, and the period of payment contingent on its rate (from 1 month to 1 year).   

 

The effect of the law is extended on the legal relations in such spheres as attraction of private funds by the financial institutions, housing construction and operations with real estate, land relations, and entrepreneurship.

 

Legal ground for the payment of compensation is a respective court resolution. The People´s Deputies believe that the bill fails to contain any effective tools to support strict observance of its provisions, and eliminate bureaucratic impediments in the realization of this right.
