The Committee on National Security and Defence recommends The Verkhovna Rada to endorse in Part the Motions of the President of Ukraine to the Law "On Amendments to the Law of Ukraine "On Military Duty and Military Service"

Опис : C:\Documents and Settings\Имя\Рабочий стол\2.jpgThe Verkhovna Rada adopted the Law (Reg. No.4071) on December 21. According to the President of Ukraine, the amendments to parts 5 and 10 of clause 25 of the Law "On Amendments to the Law "On Military Duty and Military Service" contravene the Constitution of Ukraine and other norms of this Law, as well as the established practice of their implementation.

 

Thus, the President of Ukraine does not agree to the introduction of a civil-legal liability of the military specialists dismissed from the service during five years after the end of training in the higher military education establishments, military training subdivisions of higher military education establishments or other training military units due to the termination of the contract.

 

Furthermore, the President of Ukraine does not agree with clause 25 of the law, whereby the losses for the training of the military specialists in higher education establishments, military training subdivisions of higher military education establishments or other training military units shall be recovered under the order established by the Cabinet of Ministers of Ukraine.

 

The Committee members disagreed with the above-mentioned remarks, and stated that the Cabinet of Ministers shall not set "fundamentals of the civil-legal liability" on a voluntary basis. The People´s Deputies are convinced that amendments to part 10 of clause 25 of the Law "On Military Duty and Military Service" do not infringe on the constitutional principles.

 

The Committee members upheld the motions of the President of Ukraine.
