The Committee on Justice recommends the Parliament to adopt the Bill "On Access to the Judicial Decisions" (re Particular Issues concerning Maintenance of the Register)

Опис : C:\Documents and Settings\Имя\Рабочий стол\2.jpgThe bill (Reg. No. 7369) corrects legal deficiencies in the provisions of the Criminal Procedural Code and the Law "On Access to the Judicial Decisions."

 

According to the Committee members, "legal deficiencies in the aforementioned laws concern the fact that under clause 121 of the Criminal Procedural Code, the data of the pre-trial inquiry, including judicial decisions, can be promulgated only by consent of the investigation officer or the prosecutor in the scope determined by the persons thereof, while under the Law "On Access to the Judicial Decisions", all decisions of the courts of general jurisdiction are included into the Single State Register of Judicial Decisions."  

 

The bill amends the Law "On Access to the Judicial Decisions." Namely, it supplements part 3 of clause 3 with the following sentence, "Judicial decisions on particular investigatory actions or operational search actions are included into the Register after the end of the pre-trial inquiry on respective criminal cases," while part 4 of clause 3 is presented in the following version, "The order of maintenance of the Register is ratified by the State Judicial Administration of Ukraine."
