The Committee on Justice recommends the Parliament to reject the Bill on Amendments to Clauses 98 and 119 of the Civil Procedural Code of Ukraine (re Information about the Individual Tax Identification Number in a Civil Case)

No.5077), the parties in a civil case shall state the individual tax identification number of the claimant and the respondent, and other data to correctly identify the claimant and the respondent in the civil cases in the notice of claim and the appeal for the issue of a judicial order.

 

The Committee members expressed several remarks concerning the bill. Thus, part one of clause 55 of the Constitution of Ukraine declares the right of every individual to address court to protect their rights and freedoms. However, the amendments to clauses 98 and 119 of the Civil Procedural Code of Ukraine restrict this right, since the individual addressing the court with the notice of claim or the appeal for the issue of a judicial order shall state the individual tax identification number of the respondent and the debtor, as well as other data.
